Terms and Conditions for use of Metric Analytics tool

Below are the terms that apply to the use and access to Metric's subscription software.


Metric is operated by Novamedia ehf. Id. 540606-2260. Based in Reykjavik, Iceland.


1. Software and Subscription

Metric is a subscription software.


2. Definitions

Metric: Seller Novamedia ehf.

Subscriber: A person who has purchased access to Metric's software as a subscription.


3. Subscription of software licenses

Metric sells access to Analytics Software functionality in each type of subscription channel. Access is based on one month at a time. Payment is made in advance for each month.


A subscription to Metric includes the right to use the software.


If the customer wishes to change subscription plan, such changes will take effect on the first day of the next calendar month.


Metric reserves the right to change the subscription options available without notice. Those who have already purchased a subscription route that has been changed will be notified of the changes and such changes will take effect for the subscriber on the first day of the next calendar month.


4. User Information

Username, password and other contact information that a user may provide when creating a subscription are considered a user's "access information". The user has a clear obligation to ensure the confidentiality of the username and password. If there is the slightest suspicion that an unauthorized party has obtained the username and/or password, the user must immediately change the password and report to Metric at our service desk here if he becomes aware of attempts to access by unauthorized parties.


5. Termination

Subscription can be canceled any time on the user's account panel.


6. Preservation of data at the end of the contract

In accordance with the law on personal protection, Metric does not retain the customer's data pr Analytics data after the validity period of the contract has ended or if the contract has been terminated for other reasons. The data is then deleted in Metric's systems. While the customer is obliged to preserve data based on the provisions of the law or contracts, it is the responsibility of the customer to preserve such data in accordance with the law after the contract period ends.



7. Limitation of Liability

Subscribers use the system modules available at their own risk. Metric does not guarantee that specific results will be achieved by using the software.


Metric reserves the right to interrupt access in cases where it is necessary to maintain the environment or when systems are updated. Efforts are made to ensure that this work takes place at a time that causes the least disruption to customers. Administrative access (e.g. admin) to the web management system may never be created or delivered to a third party without the written permission of an employee of Novamedia ehf.


Metric's liability for damages depends on the fact that it has shown significant negligence or gross error in the implementation of the contract.


Metric is not responsible for consequences that can be attributed to the fact that it was not possible to provide services due to uncontrollable or unforeseen reasons (force majeure), e.g. fires, strikes, epidemics, natural disasters, laws or regulations or other incidents that are not the fault of the contracting parties, or within their control.


In no case is Metric liable for indirect or consequential damages, including lost profits, planned savings or third-party claims against the customer.


Metric is not responsible for damage that may occur due to data loss, nor damage that can be attributed to changes in the supply voltage or power interruptions or other external shocks that the equipment may be subjected to. Metric is not liable for damage caused by the customer's choice of equipment from a third party or damage that is the result of incorrect use of the system by the latter or a third party, nor due to defects or malfunctions in hardware or software. Metric shall not be responsible for damage that occurs during the maintenance period and during normal work, such as data copying and maintenance.


Claims for damages must be made within one year of the damage event.


8. Violation of Terms of Use

Metric is entitled, at any time and without notice, to block a party's access to the software and, as the case may be, delete it if the subscriber is found to be in violation of these terms, abuses the system or behaves in a way that it is obvious that the person cannot or does not intend to comply with the provisions of these terms and conditions. A notice of termination will be sent to the subscriber's email address.


9. Changes to Terms

Metric may change these terms. In the event of changes, the user will be given the option to accept the changed terms. Acceptance of the updated terms is a condition for continued use of the software. If the user chooses not to accept the changed terms, the user will no longer be able to log in to the software's website and the subscriber will then be given the option to block the said user's access.


10. Law and forum

These terms, contracts and offers with customers are governed by Icelandic law. Any dispute that cannot be resolved by agreement between the parties shall be brought before the Reykjavík District Court.


These terms are valid from 01.01.2023.
